Your Feedback Is Needed

  • Background

The HOA Board of Directors had previously voted on and agreed into looking into the possibility of dissolving the HOA, as some have expressed interest.

Given that it is a legally binding covenant on all of our titles, there are a lot of costs and steps that are necessary if the majority of home owners wish to continue looking into this process.

A previous board meeting agreed to an initial budget of $2,500 for a lawyer to look into the legal aspects. Currently not all residents have paid their HOA fee’s which is hindering the ability to be able to have the funds to continue further.

All board members regardless of their positions have expressed the need to give as much information as possible so that fellow residents can make an informed and educated decision going forward as there are pro’s and con’s.

It should be noted that often fears of other HOA failures can affect the opinions of our HOA. Our HOA is only responsible for the features listed below and landscaping. That is it. They do not have any authority for parking, fences, etc.… knowing that is why the fee remains very low at approx. $8.50/month ($100/year).

We did find out that new sub divisions can now have signs at the entrances covered by the city, which potentially in our case would mean some red tape to transfer the easement.

One negative is that we all know the City rarely if ever actually maintains anything. Having an HOA insures we are in charge of keeping our signs in good condition, lighting and weeding / flowers. It is unsure if the City would remove the gazebo, rock garden and other structures that we all appreciate and like, if the HOA were to be dissolved.  We have reached out to the City, but have not received a response.

All of the Board Members are volunteers for the HOA, are not paid and we freely give our time for the benefits of our community. Below is an attached copy of the lawyer’s responses as well as a copy of the features and everything the HOA is responsible for.

  • Lawyer's Opinion Letter

Further to our correspondence in this matter, the Starling at Big Lake Homeowners Association

(the “HOA”) has asked for our opinion on the HOA’s options for dissolution. Please note that our

opinion is based on the information that you have provided to us. If the circumstances of the

matter change, it is likely that our opinion will change as well.
